SIDNEY--On Monday, June 10, Michael R. Galindo was sentenced for High DUI (over .15 BAC), Possession of Marijuana of 1/2 ounce or less, Possession of Drug Paraphernalia and Open Container of Alcohol.
The Nebraska State Patrol received a notification to be on the lookout for a car matching Galindo's vehicle's description driving in an erratic manner. A few hours after the BOLO was issued, a Nebraska State Patrol cruiser came up on Galindo's vehicle parked on the side of a county road. The reporting officer said that Galindo was in the vehicle with the front seat reclined. He had an open container of beer, which was cold to the touch, in his cupholder and the officer smelled the odor of marijuana. The car was searched and a plastic container with less than 1/2 ounce of marijuana was discovered with a pipe used to smoke the marijuana, which still contained residue of freshly-smoked cannabis.
Galindo pled guilty to High DUI, Possession of Marijuana less than 1/2 ounce, Possession of Drug Paraphernalia and Open Container of Alcohol. He was sentenced by Judge Randin Roland to nine months of probation with enrollment fees of $30 and $25 per month, a $500 fine plus court costs, and $50 charge for chemical testing. Galindo's Driver's License was revoked for one year and he was ordered to undergo random drug testing and must not enter liquor stores or bars during this period. He was credited with two days of jail time served. He must also undergo testing through the State of Nebraska prior to having his driver's license restored.
For the Possession of Marijuana charge, he was fined $300. For the Paraphernalia charge, he was fined $100 and for the Open Container violation, he was fined $50.
