Plans to purchase the Elks concession stand at the Cheyenne County Fairgrounds was greeted with a significant obstacle Monday morning.
In the Dec. 3 meeting of the county commissioners, James Lenzen met with the commissioners to discuss purchasing the building. The agreement would include purchase of the building and a five-year lease of the land it sits on. In the fairboard meeting that night, Lenzen said he does not want to compete with any nonprofit organizations. His intent is to have a place to prep and store food for his catering business, and to offer food during the county fair.
On Monday, Dec. 17, county attorney Paul Schaub said the county’s insurance carrier is concerned about liability with a the public having access to the fairgrounds at all hours.
Commissioner Philip Sanders said if NiRMA, the county’s insurance carrier, isn’t in favor of the lease, neither is he.
The board voted against a lease agreement 3-0.
The board also discussed use of the fairgrounds for the 4-H archery program in 2019. Lynn McKinney of the Cheyenne County Extension Office said they would like to meet on Tuesday evenings. She said 4-H also has a BB gun program, .22 program, and shotgun. She said each class is led by a certified instructor.
Ryan Lembke met with the commissioners regarding moving cattle on County Road 129. He said he wants a way to move cattle from his pasture to a work area across the road. At issue is he wants to construct a fixture in the easement that would allow for safely moving cattle across the road.
“If its on county property, you can’t do it,” Sanders said.
Sanders said it is part of the state statutes and if it is a state law, the commissioners won’t decided against it.
“The issue is no permanent fixture in the right of way,” said commissioner Randal Miller.
Lembke said he only needs the fixture three to four times a year. The commissioners asked Lembke and Road Supervisor Doug Hart about use of a temporary structure.
The commissioners also approved a County Assistance Application for Sherry Cabela. The funding will help her with housing through the rest of December.
