Mark Wayt, 55, of Fort Collins, Colo., had a preliminary hearing Thursday on two felony charges that were bound over to District Court.
According to a press release from the Cheyenne County Attorney’s Office, the preliminary hearing was held Thursday on the charges of Refusal to Submit to Blood, Breath, or Urine Test, a Class II Felony (with 4 or more prior driving under the influence (DUI) convictions) and Driving During Period of DUI Revocation, a Class IIA Felony.
The press release stated an officer of the Sidney Police Department testified at the hearing and the court held that it appeared the charged crimes occurred and there is probable cause to believe the defendant committed them. The case was then bound over to District Court.
In the initial complaint filed by Cheyenne County Attorney Paul Schaub, the Refusal to Submit Charge would make Wyat’s fifth DUI offense.
According to the complaint, Wyat had three previous DUI convictions from 2002 to 2016, in various counties in Wyoming and a previous conviction in Cheyenne County.
Wyat’s arraignment is set for Sept. 7 in District Court at 8:30 a.m.
