Man arrested for assault on an officer, pleads to lesser charge

A Denver man who was arrested last week by Sidney police plead guilty to a reduced charge in County Court Thursday.

Sidney police officers arrested 33-year-old Justin Lane, on Monday after he attempted to run from law enforcement.

According to the police affidavit, on August 15 at approximately 8:03 p.m. a vehicle, driven by Lane was observed with no visible registration. After Lane provided a false name and date of birth, the car’s vehicle identification number came back to the arresting officer as stolen.

The affidavit stated the officer exited his patrol car and asked Lane to do the same. When Lane was told he was being place under arrest, he began to run. After being advised to stop, and failing to do so, Lane headed west and was tased by the officer.

Before the officer was able to apprehend him, Lane attempted to get up again and was tased once more, striking his face and head against the ground.

According to the arrest affidavit, that is when Lane was alleged to have struck the arresting officer in the back of the head before running away. The officer was able to apprehend and get Lane on the ground when officer assistance arrived on the scene.

After his arrest Lane admitted swallowing heroin and injection methamphetamine.

Lane and the arresting officer were transported to Sidney Regional Medical Center (SRMC) for evaluation and later released.

According to the affidavit, upon inspection of Lane’s car an inventory of multiple syringes, two glass pipes with burnt marijuana residue, and a small ID holder that contained a white powdery substance that was later tested and showed a “presumptive positive” for the presence of heroin.

After pleading guilty, Lane was sentenced in Cheyenne County Court Thursday on a reduced charge of resisting arrest a Class I Misdemeanor and attempted possession of heroin also a Class I Misdemeanor.

Lane was sentenced to 10 days in Cheyenne County jail. Lane faces two felony charges out of Douglas County, Colorado and will be extradited to Colorado.
