Court Briefs - 01-09-14

The following people appeared in Cheyenne County Court on Tuesday, Jan. 7, before the Honorable Randin R. Roland:

Brian Everingim, age 34 of Colorado Springs, Colo. appeared for entry of plea on a charge of Obstructing a Peace Officer and Resisting Arrest. Both are class I misdemeanors. He pled guilty to Obstructing and Resisting Arrest was dismissed. He received a sentence of 11 days in jail.

William Jackson, age 44 of Dalton, appeared for a preliminary hearing on a charge of Terroristic Threats and Use of a Deadly Weapon to commit a felony. These are a class IV felony and II felony, respectively. The defendant waived his preliminary hearing and the case was bound over to district court. Arraignment has been scheduled for Jan. 14 at 9 a.m.

Jonathon Jackson, age 19 of Dalton, appeared for a preliminary hearing on a charge of Terroristic Threats and Use of a Deadly Weapon to commit a felony. Again, a class IV felony and II felony. He waived his preliminary hearing and the case was bound over to district court. Arraignment has been scheduled for Jan. 14 at 9 a.m.

Randy Palmer, age 27 of Brush, Colo. appeared for presentment on a charge of failing to register as a sex offender, a class IV felony. A preliminary hearing has been scheduled for Jan. 17 at 2:30 p.m.

The following people appeared in Cheyenne County District Court on Wednesday, Jan. 8, before the Honorable Derek Weimer:

Jennifer Cartwright, age 31 of Sidney, appeared for a status hearing on the Plea in Abatement on a charge of Possession of Methamphetamine, a class IV felony. Oral arguments have been scheduled for Jan. 15 at 1 p.m.

Tana Austad, age 43 of Sidney, appeared for sentencing on an amended charge of Attempted Possession of Hydrocodone and Attempted Prescription altering, both being class I misdemeanors. She received 24 months probation.

Cordell Releford, age 19 of Sidney, appeared for sentencing on an amended charge of Attempted Delivery/Distribution of Marijuana, a class IV felony. He received 48 months probation.

Trevor Franklin, age 20 of Sidney, appeared for sentencing on an amended charge of Distribution of Cocaine, which is a class III Felony. He received 5 years of Intensive Supervised Probation.

Jarred Neuhalfen, age 20 of Sidney, appeared for a status hearing on a two count charge of Theft by Receiving Stolen Property and Theft. The charges are a class III felony, III felony and IV felony, respectively. He then pled guilty to an amended charge of Theft by Receiving Stolen Property, a class IV Felony. Pre-sentence investigation was ordered. Sentencing scheduled for March 5 at 10:30 a.m.

Vorachit Luexayachak age 40 of Sioux City, Iowa, appeared for a status hearing on a charge of Operating a Motor Vehicle to Avoid Arrest, a class IV felony. Pursuant to a plea agreement in a companion Deuel County case the State dismissed this case with prejudice.

Joshua Pilger, age 23 of Sidney, appeared for sentencing on an amended charge of Possession of a Controlled Substance: Fentanyl, considered a class IV Felony. He received 60 months probation.

Roger Stuart, age 61 of Potter, appeared for arraignment on a charge of Distribution of Oxycontin, a class III Felony. A status hearing has been scheduled for Feb. 5 at 9:30 a.m.

Tina Sifuentez, age 44 of Lodgepole, appeared for arraignment on a charge of Possession of Methamphetamine, a class IV felony. A suppression hearing has been scheduled for Feb. 10 at 1 p.m. Her status hearing is set for Feb. 5 at 9:30 a.m.

Michael Livingstone, age 22 of Potter, appeared for arraignment on a charge of Distribution of Marijuana in a School Zone. This is a class II Felony. A status hearing has been scheduled for Feb. 5 at 9 a.m.

Lynette Robertson, age 42 of Sidney, appeared for sentencing on an amended charge of Attempted Distribution of Meth and Possession of LSD. The charges represent class III and IV felonies, respectively. She received 60-96 months (60 minimum) for the attempted distribution and 20-60 months for the possession of LSD, both to be served concurrently.

Vorachit Luexayachak age 40 of Sioux City, Iowa, appeared for a status hearing on a charge of Possession of Marijuana with Intent to Deliver/Distribute and Operating a Motor Vehicle to Avoid Arrest. The charges represent a class III felony and IV felony, respectively. He pled guilty to those counts (Cheyenne County case dismissed) and a pre-sentence investigation report has been ordered. Sentencing has been scheduled for Feb. 3 at 1:30 p.m.
