Cuffed at the hands and ankles, Dale Robertson was escorted into the Cheyenne County District Court by a deputy. Dressed in orange he sat quietly at the table, waiting for Judge Derek Weimer to enter the room. His lawyer, William Madelung, said in an aside that Robertson's life had been “tainted with drug abuse.”
Judge Wiemer sentenced the defendant to two to four years in jail, with a possible chance for probation after one year. This sentence runs consecutively with a term of one year in the county jail.
Robertson was charged with selling what is known on the street as an 8-ball, or 4.5 grams of Methamphetamine, to an undercover Criminal Investigator in Sidney on December 3, 2012.
Investigators met in Potter to set up the meth purchase through an alleged third party, Dwayne Burton, who lives northeast of the community. Burton’s case is pending, with a preliminary hearing Aug. 8 in Cheyenne County Court.
According to court reports, the CI met with Burton first at his residence then followed him to the Safeway parking lot in Sidney. The investigator left the vehicle and rode with Burton from this point.
After driving around Sidney, Burton picked up Robertson to complete the transaction, around the block from Robertson’s resident at 1536 Elm Street. The CI Handed Burton $300 in cash. Burton reportedly passed the money to Robertson, who then handed the CI a bag of meth.
Led from the courtroom Robertson passed his mother glancing at her with a sorrowful look. He had requested probation.
“I ask for probation not for myself but for my boys,” he told Judge Weimer. “I want to show my family and take care of my boys.”
Robertson's children will be cared for by their grandparents.
