In a Cheyenne County District court appearance on May 20, defendant Justin J. Warren and his attorney Kelly S. Breen, made a motion to suppress evidence at a trial of the case against him “of any and all items of evidence taken from the defendant’s living quarters or any other place in which he had an expectation of privacy on or about March 22 of this year.”
The records go on to state that the foregoing motion will be heard on June 12 in the District Court of Cheyenne County at 8:30 a.m.
The search and seizure of items from Warren’s residence occurred on the afternoon of March 22 in Gurley when the defendant was arrested for possession of meth with the intent to deliver or distribute within 1000 feet of a playground.
Investigator Zachary W. Goodrich and Chief Deputy Fred Wiedeburg executed the search warrant at the Gurley home.
Warren claimed ownership of the basement bedroom and was the sole occupant.
After searching the defendant’s residence, field tests of a white crystal substance, found in a cellophane bag with other empty smaller cellophane bags, revealed that the substance was methamphetamine. The meth was weighed in its packaging and came to be approximately 12.2 grams.
At a preliminary hearing in April, Warren’s bond reduction was denied. At this same hearing Goodrich told the court that on March 22 he was asked by Wiedeburg to help in a child abuse case that possibly involved narcotics.
In previous Kimball County court cases, Warren was sentenced on charges of burglary and attempted distribution of a controlled substance.
